Believe it or not, the biggest problem with online Wills is that many of them are never signed. So why are people paying for these documents, then not executing them? There are three main reasons:
1. People don't understand the documents they've purchased.
Most online websites will provide a Will, financial power of attorney, and several other documents. The volume can be overwhelming and people are often confused. Therefore, they wisely decide not to complete the process.
2. All Wills, including online Wills, need to be executed with the same formalities.
In Colorado, that means signing the documents before a notary and two witnesses. This can be pretty tricky to coordinate.
3. People are afraid of making mistakes.
Purchasers may basically understand the documents, but are concerned about making a mistake. And mistakes do happen: we have personally reviewed one online Will where a client gave his mom a substantial gift, then accidentally disinherited her.
